CIVIL LITIGATION SERVICES

The Civil Litigation Services Division is a Division in the Ministry of Justice which was created by the Prime Minister’s order n^o 40/03 of 25/04/2014 determining the mission, functions, organizational structure and summary of job positions of the Ministry of Justice / Office of the Attorney General. It’s a Division headed by the Division Manager/senior State Attorney. It comprises of Civil Litigation Analysts/Senior State Attorneys, State Attorneys who assists the Senior State Attorneys and one Government bailiff

Mission statement

To provide excellent expertise and services to litigation on legal matters for and on behalf of the Government and its agencies and thus enforce Justice to the public.

Strategic objectives

The division assists the Attorney General in his major role as a representative of the Government in disputes of any kind to which it is party, be it national or international. The Division has the following strategic objectives:

1. To provide advice to the Government on litigation of civil matters.
2. To provide legal expertise to the Government, on the preparation, formulation and litigation of civil cases.

3.       Initiate and conduct civil litigation on behalf of the Government, in cases which directly affect the government and in cases of public interest or where public rights are at stake.

4.       Represent the Government and its agencies in Courts or in any other legal proceedings to which the Government is a party, other than criminal proceedings

5. Represent the Attorney General in transaction committee meetings, mediation meetings, out of court settlement negotiations, arbitration tribunals and any other alternative dispute mechanisms that might be put forward to resolve disputes involving Government or its agencies;
6. Institute arbitrations and formulate defence to arbitral claims filed against the Government or to claims which the Government and its agencies has interest.
7. Coordination of work done by State Attorneys appointed in different Government institutions
8. Analyzing, preparing and drafting court briefs and arbitral memoires that are legally researched

9.       Assist the Attorney General in the recovery of court ordered civil penalties, fines, damages and court fees where the Government or its agencies are beneficiaries

10. Any other duties as may be assigned by the Attorney General
